The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Creates crime of unlawful delivery of salvinorin A or Salvia
divinorum. Punishes by maximum of 20 years' imprisonment,
$300,000 fine, or both. Creates crime of unlawful importation or
possession of salvinorin A or Salvia divinorum. Punishes by
maximum of 10 years' imprisonment, $200,000 fine, or both.
  Takes effect on 91st day following adjournment sine die.

                        A BILL FOR AN ACT
Relating to hallucinogenic substances; and prescribing an
  effective date.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2003 Act is added to and made
a part of ORS 475.940 to 475.999. + }
  SECTION 2.  { + (1) A person commits the crime of unlawful
delivery of salvinorin A or Salvia divinorum if the person
knowingly delivers salvinorin A or Salvia divinorum to another
person.
  (2) Unlawful delivery of salvinorin A or Salvia divinorum is a
Class A felony.
  (3) A person commits the crime of unlawful importation or
possession of salvinorin A or Salvia divinorum if the person
knowingly imports into this state or possesses salvinorin A or
Salvia divinorum.
  (4) Unlawful importation or possession of salvinorin A or
Salvia divinorum is a Class B felony. + }
  SECTION 3.  { + This 2003 Act takes effect on the 91st day
after the date on which the regular session of the Seventy-second
Legislative Assembly adjourns sine die. + }

- 20 Jahre Gefängnis oder 300.000$ Geldstrafe oder beides für die Weitergabe von Salvia Divinorum oder Salvinorin A
- 10 Jahre Gefängnis oder 200.000$ Geldstrafe oder beides für Erwerb und Besitz von Salvia Divinorum oder Salvinorin A

Beides gilt nur dann, wenn jemand bewusst SD weitergibt, bzw. bewusst erwirbt oder besitzt.

I live in Oregon. Thats some scary shit, but im not sure if its true. I went to the official state of oregon web site, www.oregon.gov and i did a search for "72nd OREGON LEGISLATIVE ASSEMBLY" and i got a lot of hits, so i searched them for salvia, and all i could find was the state attempting to control Salvia aethiopis, because its an unwanted plant.

Another point, House Bill 3485 was "a special session of the 1995 legislature passed HB 3485 which amended the forest Practices Act and provided alternatives to landowners when application of the rules results in more than a ten percent reduction in the volume of merchantable timber. Some of these provisions will be sunset as of July 1, 1997. The original SB 679 would have extended that sunset date. SB 679-A establishes a task force to study the rules that restrict forest prectices." This clearly has nothing to do with salvia.

The 2004 ballot will not have any of that on it. A few days ago i bought 1/4 ounce of salvia from a store located in oregon.

One thing that concerns me though is that the web adress suggests that it is on the same server as other government documents. If this was an issue in 2003 i would have heard about it, and it is not an issue in 2004. If this is a true bill then i would have to say that it was either voted down, or it was never brought to a vote.

Regardless if this is true Salvia Divinorum is currently legal in the US, and Oregon is one of the more Liberal states. Oregon does have medical weed, and there is a measure on the ballot this year about it, measure 33. This measure would allow for the sale of marijuana to patients who qualify for medical, and would allow for them to grow 10 plants legally. In areas where there are no licenced growers the state will grow your marijuana for you. It just dosn't make sense that salvia would become illegal in this state.
